1. Introduction
This Privacy Policy explains how Hole In 1 Nation (“we”, “us”) handles personal information when you use our marketing websites, golfer play app, and related services (the “Services”).
We operate in the United States and Canada. Depending on where you live, additional rights may apply under laws such as PIPEDA, applicable Canadian provincial privacy statutes, and U.S. state privacy laws.
This policy is a provisional draft pending counsel review and production privacy assessments.
2. Information we collect
We may collect:
- Identity and contact data — name, email, phone, date of birth (where required for eligibility or claims)
- Account and preference data — display name, country preference, notification settings
- Contest and transaction data — entries, bundles, receipt numbers, amounts, currency (USD/CAD), wallet ledger items
- Verification data — tee-shot footage, timestamps, review outcomes, claim documents, payout status
- Device and usage data — browser type, approximate location derived from IP or device settings you allow, diagnostics, and security logs
- Support communications — messages you send to support or accessibility contacts
3. Sources
Most information comes directly from you or from your use of the Services. We also receive footage and device telemetry from course-hosted cameras and connectivity equipment, and payment status from our payment partners.
4. How we use information
We use personal information to:
- Operate contests, process payments, issue receipts, and maintain leaderboards
- Verify results, review clips, and administer prize claims and payouts
- Provide support, dispute handling, and safety communications (including weather or hole holds)
- Secure the Services, prevent fraud, and meet legal or regulatory obligations
- Improve reliability and product experience using aggregated or de-identified analytics where practical
5. Legal bases (where applicable)
Where required, we process information based on contract performance (entries and claims), legitimate interests (security and service improvement balanced against your rights), consent (optional notifications or cookies beyond essentials), and legal obligations (tax, recordkeeping, or lawful requests).
7. Cross-border transfers
Information may be processed in Canada, the United States, or other countries where our providers operate. Where required, we use appropriate contractual or other safeguards for cross-border transfers.
8. Retention
We retain contest, payment, footage, and claim records for as long as needed to operate contests, resolve disputes, meet insurance and tax requirements, and comply with law, then delete or anonymize according to our retention schedule.
9. Security
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the data, including access controls for staff portals and signed media access patterns for private clips. No method of transmission or storage is completely secure.
10. Your choices and rights
Subject to applicable law, you may request access, correction, deletion, portability, or restriction of certain processing, and you may withdraw consent where processing is consent-based. Marketing communications can be opted out via the message or by contacting us.
California and other U.S. state residents may have additional rights regarding categories of personal information disclosed and opt-outs of certain sharing; contact us to exercise those rights. We will not discriminate against you for exercising privacy rights.
11. Children
The Services are not directed to children under 13 (or the higher age required in your jurisdiction for contest participation). We do not knowingly collect personal information from children ineligible to participate.
